Copyright Guidelines
for the Reserve Materials Collection
(for a guide to copyright generally, please visit http://libguides.lib.umt.edu/copyright)
January 2004
The library policy
for Reserve Materials (traditional paper or electronic) is derived from
the Fair Use provisions of the United States Copyright Act of 1976.
The sole purpose of the Reserve System will be to facilitate the distribution
of materials for educational use by students.

The following guidelines are established, but do not preclude
further restrictions by the Mansfield Library:
1. All materials
placed on Reserve (paper or electronic) shall be done so at the initiative
of faculty and teaching staff solely for the non-commercial, educational
usage of students.
2. It is the responsibility of the course instructor to request and
obtain copyright permission, if needed, for class materials they wish
to use for their course. This process should be initiated before placing
the material on Reserve.
A. Materials
which usually do not require Copyright Permission:
1. Exams, syllabi,
lecture notes, homework answers
2. Student Papers (assuming consent of author was given)
3. United States Government publications
4. A single article from a journal issue (for one semester only)
5. One chapter from a book (for one semester only)
B. Materials
which do require Copyright Permission:
1. Articles
from journals that are needed for more than one semester
2. Multiple articles from a single journal issue
3. A single chapter from a book that is needed for more than one
semester
4. Multiple chapters from a book
5. When an out-of-print book is needed for electronic reserve (note:
we will not place an entire book which is in print, in the Electronic
Reserve System.)
6. Materials that will be used repeatedly by the same instructor
for the same course.
3. An instructor
can request Copyright permission by:
A. Sending a
written request to the copyright holder (usually the publisher).
B. By paying a fee to the Copyright Clearance Center (http://www.copyright.com/services_guide/trsinfo.html).
(Note: the Mansfield Library and the University Center Bookstore are
both members of the CCC and may be able to assist instructors with
this process).
4. All Reserve
Materials (paper or electronic files) will be suppressed from the Reserve
system following the Semester for which they are used.
5. Copyright notification
will appear on the screen within the Electronic Reserve System and on
traditional copies of reserve readings to indicate that materials may
be covered by copyright law. Materials on Reserve should include appropriate
citations or attributions to their sources.
6. Materials on
reserve (paper or electronic) are accessible by faculty name and course
number. Electronic Reserves for copyrighted materials will be limited
to those assigned a personal or course password, so that only those
registered for the course will have access to those materials.
7. There will be
no charge for access to the Reserve Material Collection. The charge
for copies made by students will be limited to the nominal cost of photocopies
or laserprints.
